Federal Public Health Emergency Extended

Update from the Missouri Department of Developmental Disabilities

Effective October 13, 2022, the U.S. Department of Health and Human Services issued a declaration that a federal public health emergency is still in existence related to COVID-19. The previous declaration was set to expire October 13, 2022. The renewal will be effective for 90 days or until Wednesday, January 11, 2023.

The 1135 flexibilities expire upon the termination of the Federal Public Health Emergency. The CMS Appendix K Addendum flexibilities expire no later than six (6) months after the expiration of the Federal Public Health Emergency. While the State of Emergency in Missouri concluded December 31, 2021, the Federal Public Health Emergency (PHE) remains active for those flexibilities granted under the State of Emergency.

The COVID-19 Flexibility Authority Chart has been updated to depict the authority of each of the COVID flexibilities in place. If multiple authorities exist, the flexibility expires at the later of the two dates.
