According to court documents, the Howell County Prosecuting Attorney Michael Hutchings filed a notice of intent to seek the death penalty for 31-year-old Joey Marcak of West Plains. The notice was filed May 27.
Marcak has been charged with six felonies, including two counts of first-degree murder for the deaths of Richard L. Kuntz, 30, West Plains, and Frankie L. Ziegler, 28, Mtn. View in May.
Marcak has entered a not guilty plea.

MAY 9th UPDATE: The Howell County Prosecuting Attorney’s Office has formally charged the third suspect in Tuesday’s double homicide.
Joey Allen Marcak has been charged as follows:
Two (2) counts Murder 1st Degree
Three (3) counts Armed Criminal Action
One (1) count Robbery 1st Degree
Marcak’s bond is set at $1,000,000 cash or corporate surety.

MAY 8TH UPDATE: Investigators with the West Plains Police Department, Howell County Sheriff’s Office, the South Central Drug Task Force, and Missouri State Highway Patrol are continuing to investigate the double murder of Frankie L. Ziegler and Richard L. Kuntz that occurred on Tuesday, May 5, 2020.
Investigators arrested two suspects, Kyla R. Croney, age 34, and Levi Daniel Gunter, age 37, just after midnight on May 7, 2020.
The West Plains Police Department then arrested Joey Allen Marcak, age 31, in the 1100 block of Lincoln Street on May 7, 2020 at 3:29 p.m.
The Howell County Prosecutor’s Office filed charges of two Counts of First-Degree Murder, two counts of Armed Criminal Action and one Attempted Robbery on Kyla Croney and Levi Daniel Gunter with bonds set at $500,000 each. Charges on Joey Allen Marcak are pending.
