Federal COVID-19 Public Health Emergency Extended

Effective January 14, 2022, the U.S. Department of Health and Human Services issued a declaration that a federal public health emergency is still in existence related to COVID-19. The previous declaration was set to expire January 16, 2022. The renewal will be effective for 90 days or until Thursday, April 14, 2022.

The 1135 flexibilities expire upon the termination of the Federal Public Health Emergency. The CMS Appendix K Addendum flexibilities expire no later than six (6) months after the expiration of the Federal Public Health Emergency. While the State of Emergency in Missouri concluded December 31, 2021, the Federal Public Health Emergency (PHE) remains active for those flexibilities granted under the State of Emergency.

The COVID-19 Flexibility Authority Chart has been updated to depict the authority of each of the COVID flexibilities in place. If multiple authorities exist, the flexibility expires at the later of the two dates.
