DOUGLAS COUNTY, Mo. — A Douglas County grand jury has indicted Philip Michael Paul Murphy on felony firearm and stealing charges stemming from an alleged July incident.
According to the indictment filed Aug. 17 in Douglas County Circuit Court, Murphy is charged with class C felony unlawful possession of a firearm and class D felony stealing. The indictment identifies Murphy as a prior felony offender.
Prosecutors allege that on or about July 28, Murphy knowingly possessed a .22 caliber revolver with pink handle grips. The indictment alleges Murphy was prohibited from possessing the firearm because of felony convictions entered in Riverside County, California, in September 2006 for sex with a minor three or more years younger and lewd or lascivious acts with a child under 14.
The stealing charge alleges Murphy appropriated the same .22 caliber revolver without the owner’s consent and with the purpose of depriving the owner of the property.
Associate Circuit Judge Elizabeth A. Bock issued a warrant Aug. 17 and set Murphy’s bond at $5,000 cash with a condition prohibiting firearms. The warrant was served by the Douglas County Sheriff’s Office at 3:48 p.m. Aug. 18.
Murphy appeared before Circuit Judge R. Craig Carter for arraignment Aug. 19. Attorney Chase Edmond Opolka subsequently entered an appearance on Murphy’s behalf and filed a motion for discovery.
A hearing in the case is scheduled for 9 a.m. Monday, Aug. 24, before Carter in Douglas County Circuit Court.
All charges are allegations, and defendants are presumed innocent unless and until proven guilty in a court of law.
